Matt Ferguson, an attorney with the Aspen law firm of Garfield and Hecht, who represents a number of buyers in the Keefe v. Base Village Owner consolidated lawsuit, said it is his perception that Base Village Owner, LLC and Related do not want to close on the condos at this point, even if the original buyers still wanted to, because it could complicate a foreclosure sale of the Base Village project set for Nov. 17.

ASPEN SNOWMASS REAL ESTATE – A Texas limited partnership filed a lawsuit in Pitkin County District Court Wednesday against Base Village Owner, LLC over two condo units it put under contract in the Viceroy hotel in Base Village. J&J Asset Company, Ltd of Texas said that Base Village Owner, a division of the Related Companies of New York, has failed to schedule a closing for two condo units it had under contract and has also refused to return $215,250 in deposit money it put down on the two condos in 2008.The suit claims that Base Village Owner knew its construction loan for the Base Village project was in jeopardy when it agreed to sell the two condo units and that it “had neither the intention nor the ability to close on the sale of the units.”
