A massive driveway on slopes in excess of 45 degress requiring several tiered retaining walls between 7 and 14 feet apiece has been proposed once again by the Stranahan family to access their 62-acre residential property off Woody Creek Road. In 2011, Pitkin County denied permission for the driveway as the Land Use Code prohibits development on slopes exceeding 30 degrees. The County learned later that denying an owner access to their property is an illegal takings of property rights. Despite being legally obliged to approve the application, commissioners could not find the will to approve the mega-driveway or deny it, so they’ve put it on hold again for a month hoping a solution can be miraculously found.
