ASPEN AND SNOWMASS REAL ESTATE – A group of buyers seeking to get $13 million worth of deposits back on condos at the Viceroy in Snowmass Village say the actual units are smaller than the ones they agreed to buy before the hotel was built.A group of plaintiffs in the Pitkin County district court lawsuit of Michael Keefe, et al versus Base Village Owner, LLC (BVO), Related WestPac Real Estate, LLC and Destination Snowmass Services, Inc., say almost every condo is smaller by 7 to 10 percent.Base Village Owner and Related WestPac are subsidiaries of the Related Companies, a large New York development company, and are the developers of the Base Village project at the base of the Snowmass Ski Area. Destination Snowmass Services is the court-appointed receiver in a foreclosure suit filed against BVO and Related by Hypo Real Estate Capital Corp., a consortium of European banks that loaned Related the money to build Base Village and the 157-unit Viceroy hotel.
